The standard of sick leave pay in Shanghai is determined according to the continuous length of service and vacation time of the employee.
Specific criteria are as follows:
1. If the employee takes a continuous leave for illness or non-work-related injury within 6 months, the company shall pay the sick leave salary:
• For those with less than 2 years of continuous service, 60% of their salary will be calculated.
• For those who have worked continuously for less than 4 years, they will be paid at 70% of their salary.
• For those who have worked continuously for less than 6 years, they will be paid at 80% of their salary.
• For those who have worked continuously for 6 years but less than 8 years, they will be paid at 90% of their salary.
• For those who have worked continuously for 8 years or more, they will be paid at 100% of their salary.
2. If the employee is on leave for more than 6 months continuously due to illness or non-work-related injury, the enterprise shall pay the sickness relief fee:
• For those with less than one year of continuous service, 40% of their salary will be paid.
• For those who have worked continuously for less than 3 years, 50% of their salary will be paid.
• For those who have worked continuously for 3 years or more, they will be paid at 60% of their salary.
In addition, if the employee's treatment for illness or non-work-related injury is higher than the average monthly salary of the city in the previous year, the salary can be calculated according to the average monthly salary of the city in the previous year. The number of sick days shall be calculated according to the actual number of leave days, and the consecutive leave period containing rest days and holidays shall be excluded.

The employee's sick leave salary or sickness relief fee shall not be less than 80% of the minimum wage of the employee of the enterprise in this Municipality in the current year. 1 The minimum standard does not include the pension, medical, unemployment insurance and housing provident fund that should be paid by the individual employee.
